CRC advocates for compliant ERISA appeals as administrative remedies before any litigation by healthcare providers and patients to avoid costly and lengthy litigation. However, when ERISA litigation becomes inevitable even with good faith ERISA appeals completely exhausted, intentional noncompliance or reckless violation of ERISA claim regulations must be defended. We believe that the successful "ERISA-accurate" exhaustion of administrative remedies, based on accurate and objective facts under tested strategies, will ensure positive outcomes in most litigation.
Although CRC is not law firm and does not practice law, we have specialized skills and knowledge to assist litigators in the formation, preparation and support of preparing a case file for litigation.
Often CRC will be asked to perfect the “exhaustion of all administrative remedy” in cases planned for submission to federal court or to ensure that all files contained in a complaint have been fully exhausted on the administrative side of ERISA for the judicial engagement.
These cases are generally, not brought to litigation by CRC on behalf of its clients, but brought to us by litigation teams determined to prevail in their planned actions.  In such cases, CRC’s industry insight, knowledge and data base of hundreds of thousands of claims can be brought to build a case file that has a very strong chance of surviving multiple strategic attacks.
For our existing clients, CRC will forward its perfected case file to any attorney specified when a client makes a judgment that litigation is warranted.  CRC has friendly relationships with several specialized law firms and can refer clients into these firms where, because of the firms familiarity with CRC’s abilities, they will normally accept a client assignment for remedy in federal court on a ‘contingent fee basis’. In these cases, CRC stands ready to assist the litigation team at no additional charge, at our client’s direction.
